What is a Divorce Appraisal?

A divorce appraisal determines the value of marital property owned by a husband and wife as of a specific date. Family law courts must approve the division of real estate assets and often require certified appraisals to ensure that the division is equitable. Likewise, many people who are terminating their marriage enter into voluntary settlement agreements and must be satisfied that any division of real estate is equitable. This is especially important when one spouse is buying the interest of the other spouse. To save money, some people do not obtain a certified appraisal from a certified appraiser. Instead, they obtain a Competitive Market Analysis (CMA) from a real estate agent. Real estate agents are generally not licensed appraisers and, consequently, cannot represent their valuation as an appraisal. Most importantly, the methodology involved in producing a CMA is not the same as what is required by law to produce an appraisal. Before selling or dividing marital real estate, an appraisal prepared by a certified appraiser is highly recommended.


Short Sale Negotiations

In a short sale, the mortgage lender agrees to discount the loan balance in order to assist the property owner in selling his or her property. A short sale may result in the lender being paid the discounted amount, or it may result in the lender allowing the buyer to assume the discounted loan.

Most people who intend to list their home for sale with a real estate broker ask a real estate agent to provide a list of recent sales that are comparable and a recommended asking price. While most real estate agents are honest and try to be objective in their analysis, they have a conflict of interest when it comes to recommending an asking price. While the property owner wants to maximize his or her net proceeds, the real estate agent wants to sell the property as fast as possible and with the least investment of his or her time. Sometimes the conflict works to the disadvantage of the property owner. By obtaining a real estate appraisal before interviewing agents, a property owner is better equipped to determine the optimum asking price. It also helps the property owner in selecting a real estate agent.
